Which product do you have installed, the Oxygen XML Editor or the Oxygen XML Author?

Oxygen already ensures that a single instance of the application launcher is running. However, it's possible that you are running a different application (e.g. Author) than the one associated with XML files (e.g. Editor).
Are you sure that the newly started instance is of Oxygen XML Author or is it the Editor?
There's also the possibility of having different versions running of the same application (assuming you have multiple versions installed).

Note that the Editor also has an Author launcher. However, if you've installed the Editor product, it's the Editor launcher that is associated with XML at installation time. That means when you double click an XML file, the Editor is started.

If you work strictly with the Author and want it associated with XML files (even though you've installed the Editor product), you can associate it with XML files in Windows Control Panel > Programs > Default Programs > "Associate a file type or protocol with a program". Look for .xml in the list, select it, press "Change program" and pick the Oxygen XML Author (you may have to browse for it).
